Terms of Service

Please read these Terms of Service ("Terms", "Terms of Service", "Agreement") carefully before downloading, installing, accessing, or using the GPS Map Camera: Geo Timestamp mobile application (the "App", "Service") operated by SUSAMP INFOTECH, a company organized under the laws of India ("we", "us", "our", "Company").

By downloading, installing, or using the App, you ("User", "you", "your") agree to be bound by these Terms. If you do not agree to all of the Terms, you must not download, install, or use the App. These Terms constitute a legally binding agreement between you and SUSAMP INFOTECH.

1. Eligibility and Account

1.1 You must be at least 13 years of age to use the App. If you are between 13 and the age of legal majority in your jurisdiction (typically 18 years), you may use the App only with the involvement, supervision, and consent of a parent or legal guardian who agrees to be bound by these Terms.

1.2 By using the App, you represent and warrant that: (a) you have the legal capacity to enter into this Agreement; (b) you will use the App in compliance with these Terms and all applicable laws; and (c) all information you provide is accurate and truthful.

1.3 The App does not require you to create an account. However, certain features (such as in-app purchases, email configuration, or sharing) may require you to use third-party accounts (Apple ID, email accounts, etc.) governed by their respective terms.

2. License to Use the App

2.1 Subject to your compliance with these Terms, SUSAMP INFOTECH grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial use, except as expressly permitted under any paid plan you subscribe to.

2.2 This license is also subject to the Apple App Store Terms of Service and the Usage Rules set forth in the Apple Media Services Terms and Conditions ("Usage Rules").

2.3 You shall NOT, and shall not permit others to:

• Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works of the App;
• Rent, lease, lend, sell, redistribute, sublicense, or otherwise commercially exploit the App;
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices in the App;
• Use the App in any manner that could damage, disable, overburden, or impair our servers or networks;
• Use any robot, spider, crawler, scraper, or other automated means to access the App;
• Use the App to violate any applicable law, regulation, or third-party right;
• Bypass or attempt to bypass any security, advertising, or access controls in the App.

3. Description of Services and Features

3.1 The App is a photo and video capture utility that allows you to add ("stamp") information overlays onto images and videos taken with the App, including but not limited to:

• GPS coordinates (latitude, longitude in DMS or decimal format);
• Address and place names (geocoded from coordinates);
• Date and time stamps in various formats;
• Map snapshots (Normal, Satellite, Terrain, Hybrid views);
• Altitude, accuracy, compass direction, and magnetic field readings;
• Weather information (temperature, humidity, pressure, wind speed);
• Sound decibel (dB) level readings;
• Country flags, custom logos, notes, hashtags, contact numbers, and person names;
• PDF reports of captured work, video stamps, camera tracking, and image clustering by location.

3.2 The App also offers customizable templates (Classic and Advance), grid/ratio settings, front and rear camera support, flash, focus, mirror, timer, capture sound, dark mode, multiple languages, email configuration for sharing, and other features that may be added or removed from time to time at our sole discretion.

3.3 We reserve the right to modify, suspend, or discontinue any feature, template, or functionality of the App, in whole or in part, at any time without prior notice and without liability to you.

4. Location, Sensor, and Camera Permissions

4.1 To function, the App requires permission to access:

• Camera and Microphone — to capture photos and videos and record sound levels;
• Location Services (GPS) — to obtain latitude, longitude, altitude, accuracy, and address information;
• Photo Library — to save captured media and (optionally) to import images for stamping;
• Motion & Compass Sensors — to determine direction, magnetic field, and orientation;
• Network/Internet — to fetch maps, weather data, addresses, advertisements, and to enable sharing;
• Notifications — to deliver service-related alerts (where applicable).

4.2 You may grant or revoke these permissions at any time through your device settings. Revoking permissions may disable or impair certain features of the App. The App will not function as intended without Camera and Location permissions.

4.3 You acknowledge that all location, sensor, weather, and environmental data displayed or stamped by the App is provided on an "as available" and "best effort" basis. The accuracy of such data depends on your device, network connectivity, satellite reception, third-party data providers, and surrounding environmental conditions, and may contain errors, delays, or omissions.

5. User Content and Ownership

5.1 "User Content" means all photographs, videos, images, notes, hashtags, custom logos, person names, contact numbers, captions, and other content that you create, capture, upload, or stamp using the App.

5.2 You retain all ownership rights in your User Content. The App processes User Content locally on your device for stamping and saves the resulting media to your device's photo library and/or shares it as you direct.

5.3 You are solely and exclusively responsible for your User Content, including for ensuring that:

• You have the legal right to capture, stamp, store, and share the content (including the right to photograph any persons, private property, or copyrighted materials depicted);
• Any logos, person names, contact numbers, or trademarks you embed are owned by you or used with proper authorization;
• Your use of the App and the content you create complies with all applicable privacy, image rights, intellectual property, surveillance, and data protection laws (including the Indian Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, the GDPR, the CCPA, and similar laws of other jurisdictions);
• You comply with all signage, posted notices, and venue rules regarding photography and recording.

5.4 SUSAMP INFOTECH does not claim ownership of your User Content. To the extent the App transmits any data to our servers or third-party services for processing (such as reverse geocoding, weather lookup, or analytics), you grant us a limited, worldwide, royalty-free license to use such data solely for the purpose of providing and improving the Service, in accordance with our Privacy Policy.

6. In-App Purchases and Subscriptions

6.1 The App is offered as a free download with optional in-app purchases. Current paid options may include, without limitation:

• "Remove Ads" — removes advertisements displayed within the App;
• "Unlock all features with Ads" — unlocks premium templates and features while still showing advertisements;
• "Unlock all colors & remove ads" — unlocks all features and removes advertisements.

6.2 All in-app purchases are processed exclusively through the Apple App Store using your Apple ID. Pricing is set in your local currency and may vary by region, taxation, and currency exchange rates. The Company does not directly process or store your payment information.

6.3 Purchases are governed by Apple's Media Services Terms and Conditions. Any billing inquiries, refund requests, payment disputes, or subscription management must be directed to Apple. We have no control over Apple's refund decisions.

6.4 All purchases are final and non-refundable except as required by applicable law or as expressly granted by Apple. Restoring previously purchased non-consumable purchases may be available through the App's "Restore Purchase" function.

6.5 We reserve the right to add, remove, or change the price of in-app purchases at any time without notice. Changes will not affect purchases already completed.

6.6 If any subscription-based features are offered: subscriptions automatically renew at the end of each billing period unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple ID account settings.

7. Advertising and Third-Party Services

7.1 The free version of the App is supported by advertisements served by third-party advertising networks (such as Google AdMob and similar providers). These networks may collect and use information about your interaction with ads, your device, and limited identifiers (such as the Apple Advertising Identifier, IDFA, where permitted) to provide personalized advertising and analytics.

7.2 The App also integrates with third-party services to provide certain features, including but not limited to:

• Apple Maps and/or Google Maps services for map rendering and geocoding;
• Weather data providers for temperature, humidity, pressure, and wind information;
• Apple App Store for in-app purchases and downloads;
• Email and messaging services for sharing captured media.

7.3 We are not responsible for the content, accuracy, availability, privacy practices, or terms of any third-party services, advertisements, or linked websites. Your interactions with these third parties are governed by their own terms and privacy policies, and are at your sole risk.

7.4 You can manage your advertising preferences (including opting out of personalized advertising and Apple's App Tracking Transparency prompt) through your device privacy settings.

8. Privacy

8.1 Your use of the App is also governed by our Privacy Policy, which is available at https://sites.google.com/view/susamp-privacy-policy and is incorporated into these Terms by reference.

8.2 The Privacy Policy describes the categories of information we and our third-party partners collect, how it is used, with whom it is shared, and your rights with respect to such information. Please review it carefully before using the App.

8.3 You acknowledge that location, sensor, and stamped-image data is sensitive in nature. You are responsible for protecting your captured media and for the consequences of sharing it with third parties.

9. Acceptable Use Restrictions

9.1 You agree NOT to use the App, directly or indirectly, for any of the following:

• Stalking, harassing, surveilling, or tracking any individual without their lawful consent;
• Capturing photographs or videos of individuals in places where they have a reasonable expectation of privacy (restrooms, changing rooms, private residences, etc.);
• Photographing or recording in locations where photography is prohibited by law, regulation, or posted notice (military installations, certain government buildings, courts, secure facilities, etc.);
• Producing content that is illegal, defamatory, obscene, threatening, infringing, or otherwise objectionable;
• Capturing or distributing child sexual abuse material or any content that exploits or endangers minors;
• Forging, falsifying, or misrepresenting timestamps, locations, weather, or other stamped data with intent to deceive, defraud, or mislead any person, court, regulator, employer, insurer, or authority;
• Using stamped images as the sole basis for legal, evidentiary, insurance, or compliance claims without independent verification;
• Reselling, sublicensing, or distributing the App or its outputs in violation of these Terms.

9.2 You acknowledge that violation of this Section may result in immediate termination of your license, removal from the App Store, and may expose you to civil and criminal liability under applicable law.

10. Accuracy Disclaimer for Stamped Data

10.1 You acknowledge that:

• GPS coordinates may be inaccurate due to weak satellite signals, indoor use, urban canyons, weather, or device limitations;
• Addresses are derived through reverse geocoding and may be approximate, outdated, or incorrect;
• Weather data is sourced from third-party providers and may not reflect actual conditions at your exact location;
• Date and time stamps depend on your device clock and time zone settings, which can be modified by you or your device;
• Sensor readings (compass, magnetic field, altitude, sound dB) can be affected by interference, calibration, hardware variation, and environment.

10.2 The App and its outputs are NOT certified surveying, navigation, scientific, forensic, or evidentiary instruments. Stamped images should not be used as the sole or primary evidence in legal, insurance, regulatory, surveying, navigation, aviation, maritime, emergency, life-safety, or compliance contexts. You assume all risk associated with relying on the App's outputs.

11. Intellectual Property Rights

11.1 The App, including all software, source code, design, graphics, user interface, templates, stamps, icons, logos, text, trademarks, and content (other than User Content), is owned by SUSAMP INFOTECH and/or its licensors and is protected by copyright, trademark, and other intellectual property laws of India and other jurisdictions.

11.2 "GPS Map Camera", "SUSAMP INFOTECH", and associated logos and stamp designs are trademarks of the Company. You are not granted any right or license to use these marks except as required to use the App as permitted under these Terms.

11.3 Apple®, App Store®, iOS®, iPadOS®, macOS®, visionOS®, and related marks are trademarks of Apple Inc. All other trademarks are the property of their respective owners.

11.4 If you believe that any content in the App infringes your copyright or other intellectual property right, please contact us at the email address provided in Section 21 with sufficient information to investigate the claim.

12. Updates, Modifications, and Availability

12.1 We may, from time to time, develop and provide App updates, including upgrades, bug fixes, patches, new features, and modifications ("Updates"). Updates may also modify or delete certain features and functionality. You agree that we have no obligation to provide any Updates or to continue to provide or enable any particular features or functionality.

12.2 Based on your device settings, when your device is connected to the internet either: (a) the App will automatically download and install all available Updates; or (b) you may receive notice of or be prompted to download and install available Updates.

12.3 You shall promptly download and install all Updates and acknowledge and agree that the App or portions thereof may not properly operate should you fail to do so. You further agree that all Updates will be deemed part of the App and be subject to all terms and conditions of these Terms.

13. Term and Termination

13.1 These Terms remain in effect from the moment you first install or use the App until terminated by you or by us in accordance with this Section.

13.2 You may terminate this Agreement at any time by uninstalling and ceasing all use of the App.

13.3 We may suspend or terminate your right to use the App at any time, with or without notice, if we believe in good faith that you have violated these Terms, infringed third-party rights, engaged in unlawful conduct, or otherwise acted in a manner that may cause harm to us, other users, or third parties.

13.4 Upon termination: (a) all rights and licenses granted to you will immediately cease; (b) you must immediately uninstall and delete the App from all devices; and (c) all provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13.5 Termination does not entitle you to any refund of any in-app purchases except as required by applicable law or Apple's policies.

14. Disclaimer of Warranties

14.1 THE APP AND ALL CONTENT AND SERVICES PROVIDED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SUSAMP INFOTECH AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT.

14.2 We make no warranty that: (a) the App will meet your requirements; (b) the App will be uninterrupted, timely, secure, or error-free; (c) any data, location, weather, sensor, address, time, or other information provided through the App will be accurate, reliable, or complete; (d) defects will be corrected; or (e) the App is free of viruses or other harmful components.

14.3 Any material downloaded or otherwise obtained through use of the App is accessed at your own discretion and risk, and you are solely responsible for any damage to your device, loss of data, or other harm that results from such use.

15. Limitation of Liability

15.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SUSAMP INFOTECH, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, including but not limited to loss of profits, revenue, data, goodwill, business opportunity, or other intangible losses, arising out of or relating to your access to or use of (or inability to access or use) the App, even if we have been advised of the possibility of such damages.

15.2 Without limiting the foregoing, we shall not be liable for any damages, losses, or claims arising from:

• Inaccurate or unavailable GPS, location, address, weather, time, or sensor data;
• Loss, corruption, or unauthorized access to your photos, videos, or stamped media;
• Reliance on stamped images for legal, evidentiary, navigational, surveying, insurance, or safety-critical purposes;
• Acts or omissions of third-party advertising networks, payment processors, map providers, or weather data providers;
• Loss of in-app purchases due to device loss, account changes, or App removal;
• Disputes between users and third parties arising from User Content or its use.

15.3 TOTAL AGGREGATE LIABILITY: To the maximum extent permitted by law, the total aggregate liability of SUSAMP INFOTECH to you for all claims arising out of or relating to the App or these Terms shall not exceed the greater of: (a) the total amount you paid to us (or to Apple for in-app purchases credited to us) for the App in the twelve (12) months preceding the event giving rise to the claim; or (b) ₹1,000 INR (One Thousand Indian Rupees).

15.4 Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. To the extent any such limitation is prohibited, our liability shall be limited to the smallest extent permitted by law.

16. Indemnification

16.1 You agree to defend, indemnify, and hold harmless SUSAMP INFOTECH and its directors, officers, employees, agents, affiliates, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees and court costs) arising out of or relating to:

• Your access to, use of, or misuse of the App;
• Your User Content, including any claim that it infringes third-party rights or violates any law;
• Your violation of these Terms or any applicable law or regulation;
• Your violation of any third party's rights, including privacy, publicity, or intellectual property rights;
• Any photographs or recordings you make of individuals, property, or restricted locations;
• Your reliance on stamped data for any purpose; and
• Any disputes between you and any third party arising from your use of the App.

17. Apple App Store — Additional Terms

17.1 You acknowledge and agree that these Terms are concluded between you and SUSAMP INFOTECH only, and not with Apple Inc. ("Apple"). SUSAMP INFOTECH, not Apple, is solely responsible for the App and its content.

17.2 The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the App may also be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.

17.3 Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App. Any claims, losses, liabilities, damages, costs, or expenses attributable to any failure of the App to conform to any warranty are the sole responsibility of SUSAMP INFOTECH.

17.4 SUSAMP INFOTECH, not Apple, is responsible for addressing any claims relating to the App or your possession and/or use of it, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation, including in connection with the App's use of any Apple frameworks.

17.5 In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, SUSAMP INFOTECH, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

17.6 You represent and warrant that: (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

17.7 You acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

18. Governing Law and Dispute Resolution

18.1 These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

18.2 Subject to Section 18.3, the courts located in Surat, Gujarat, India shall have exclusive jurisdiction over any dispute, controversy, or claim arising out of or relating to these Terms or the App, and you irrevocably consent to the personal jurisdiction of such courts.

18.3 At our sole option, any dispute, controversy, or claim arising out of or relating to these Terms or the App may be referred to and finally resolved by arbitration administered under the Arbitration and Conciliation Act, 1996 of India. The seat of arbitration shall be Surat, Gujarat, India. The language of the arbitration shall be English. The arbitral tribunal shall consist of a sole arbitrator appointed by mutual consent or, failing that, in accordance with the Act.

18.4 Notwithstanding the above, we may seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property or confidential information.

18.5 If you are a consumer in the European Union, the United Kingdom, or another jurisdiction whose mandatory consumer protection laws grant you the right to bring claims in your local courts under local law, those rights shall not be affected by this Section.

19. Export Compliance

19.1 The App may be subject to export control laws of India, the United States, and other jurisdictions. You agree to comply with all applicable export and re-export control laws and regulations, including the Indian Foreign Trade (Development and Regulation) Act and U.S. Export Administration Regulations, and not to export, re-export, or transfer the App to any prohibited country, entity, or person.

20. Changes to These Terms

20.1 We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will indicate the "Last Updated" date at the top of these Terms. Material changes may be notified to you through the App, by email, or by posting a notice in the App Store listing.

20.2 Your continued use of the App after any modification constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App and uninstall it from your devices.

21.2 For grievances under the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023 of India, you may contact our designated Grievance Officer at the email address above.

22. Miscellaneous

22.1 Entire Agreement. These Terms, together with the Privacy Policy and any Apple Media Services Terms, constitute the entire agreement between you and SUSAMP INFOTECH regarding the App, and supersede all prior or contemporaneous understandings.

22.2 Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

22.3 No Waiver. No failure or delay by us in exercising any right under these Terms shall operate as a waiver of that right.

22.4 Assignment. You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.

22.5 Force Majeure. We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, government actions, internet outages, third-party service outages, or pandemics.

22.6 Headings. Section headings are for convenience only and shall not affect the interpretation of these Terms.

22.7 Language. These Terms are written in English. Any translation is provided for convenience only. In the event of any conflict, the English version shall prevail.
